Regular Meeting

October 26, 2021

Barrett opened the meeting at 6:30 p.m. with the Pledge of Allegiance.

 

ROLL CALL OF MEMBERS:
Barrett, Miller, Henry, Howard and Tuttle.

 

ABSENT: Orr and Hoffman.

 

ALSO PRESENT:
Neil Erickson, Building Inspector, Becky Wrubel, Clerk and Rob Usakowski, Supervisor.

 

No objections to having Brad Barrett run the meeting.

 

  1. APPROVAL OF AGENDA-REGULAR MEETING

    Henry motioned to approve the agenda as presented supported by Tuttle.

     

    ROLL CALL VOTE: YES: Henry, Tuttle, Howard, Miller and Barrett. NO: None. ABSENT: Orr and Hoffman. (5-0-2) Motion Carried.

     

  2. APPROVAL OF THE MINUTES SEPTEMBER 28, 2021 and OCTOBER 12, 2021

    Miller motioned to approve the minutes for September 28, 2021 and October 12, 2021 as presented supported by Tuttle.

     

    ROLL CALL VOTE: YES: Miller, Tuttle, Howard, Henry and Barrett.

    NO: None. ABSENT: Orr and Hoffman. (5-0-2) Motion Carried.

     

  3. NEW BUSINESS

    None.

 

  1. OLD BUSINESS
    1. Site Plan Review: 74-25-002-3005-010: 2600 Wadhams Rd. High Grade

    Special Use was approved at the last meeting.

     

    Erickson: Finalized plan has been submitted. They are waiting for the testing and location of the hydrant.

     

    Barrett: Will there be a Health Department Permit?

    Variance of the ZBA was approved. Asked about signage and if that will need to be approved.

     

    Discussion.

     

    Barrett suggested to postpone the approval of a Site Plan for 2600 Wadhams Road for High Grade.

     

    We didn’t see signage so do they want us to approve it with the signage?

     

    Discussion.

     

    Barrett: The Site Plan that we had a month ago does not include the location of this proposed fire hydrant and that location is unknown at this time.

     

    Henry motioned to postpone the approval of High Grade until testing is done second by Tuttle.

     

    ROLL CALL VOTE: YES: Henry, Howard and Barrett. NO: Miller and Tuttle. ABSENT: Orr and Hoffman. (3-2-2) Motion Carried.

     

    1. Site Plan Review: 74-25-002-3006-100: Wadhams/Horseshoe. Vinckier’s – A&W

    Barrett mentioned that the motion that was approved from the last meeting was a tentatively approve with the understanding final approval will occur on October 26, 2021 for the proposed new restaurant for Vinckier’s vacant property on Horseshoe Drive with the stipulations in the Tetra Tech letter dated September 28, 2021 supported by Hoffman. That did pass.

     

    Barrett: Do we want to continue the tentative approval or do you want to stop the tentative approval and postpone the overall Site Plan for the A & W?

 

Discussion.

 

Barrett: Do you have an amended Site Plan Neil?

 

Erickson: Not at this time.

 

Miller motioned to keep the tentative approval with the understanding that the final approval will be November 23, 2021 for the proposed new restaurant of Vinckier’s vacant property on Horseshoe Drive supported by Tuttle.

 

ROLL CALL VOTE; YES: Miller, Tuttle, Henry, Howard and Barrett. NO: None. ABSENT: Orr and Hoffman. (5-0-2) Motion Carried.

 

  1. Draft MMA Ordinance

We received templates from several townships. How would the board like to proceed regarding the draft of a MMA Zoning Ordinance? We’ve done this a couple of ways before. One way was to have the township attorney to draft something and then we review it, and pick and choose what we want for the township. Another way is to have a workshop and go over all the templates from the other townships and pick what we like from them.

How would you like to draft an MMA Zoning Ordinance?

 

Discussion.

 

Usakowski: Discussion regarding Ordinance Enforcement as a Civil Issue, versus Criminal Action as Law Enforcement.

 

Board requested a packet of similar ordinances.

 

Barrett described anticipated process including Public Hearing, Metro Planning and Township Board Review.

 

Howard motioned to have the workshop on Monday, November 8, 2021 at 6:30 p.m. supported by Tuttle.

 

ROLL CALL VOTE: YES: Howard, Tuttle, Henry, Miller and Barrett.

NO: None. ABSENT: Orr and Hoffman. (5-0-2) Motion Carried.

 

  1. AUDIENCE PARTICIPATION

    Kristina Nelson: Contacted Sheriff King and he is in support of ordinance.

     

    Proposed Ordinance Certificate Renewal. Discussion regarding Zoning in Industrial Zone and possibly C-2 and C-3.

     

    Matt Crowe: Question regarding Ordinance Enforcement and who would be responsible.

    Erickson: There was a denial for a variance on a barn on Griswold Road greater than the square footage of the house.

     

    There was a variance for a six foot side yard setback for S. Birch Hill that was approved for an accessory building.

     

    Usakowski: We received our first tranche of the American Rescue Act money last week of $450,000. We will receive a total of $900,000.

 

  1. ADJOURNMENT

    Miller motioned to adjourn the meeting at 7:43 p.m. supported by Henry.

    Motion Carried.
