Public Hearing/Regular Meeting
October 28, 2025

Open Meeting: Meeting opened at 6:30 PM with the Pledge of Allegiance  
  
Roll Call of Members: Present: Orr, Barrett, Miller, Tuttle, Henry, Lokers
                                                      Absent: Howard
    
Also Present:    Clerk Wrubel, Supervisor Usakowski, Township Attorney Mr. Francis, Neil Erickson
  
  1. Approval of Agenda: Public Hearing/Regular Meeting  
                Motion to approve the agenda as presented made by Barrett, Supported by Tuttle.
                All were in favor. Motion carried.
 
  1. Approval of the September 23, 2025, Minutes  
Correction on Page 3 1661 Range Rd “Site” plan, not Master plan.
Barrett motions to approve the Sept. 23, 2025, minutes with correction. Miller supported motion. All were in favor. Motion carried.
  
  1. Public Hearing  
  1. PUBLIC HEARING: Application for Special Exception for Soil Removal for property located on Lapeer Rd (Tax ID: 74-25-004-1002-1000) 
Motion to open Public Hearing at 6:33pm by Barrett. Supported by Henry. All were in favor and Public Hearing opened.
 
Public Hearing:
Property Owner, Steven Wessel who lives at 1208 Scott Rd. wants a 1 ½ acre pond on the property located on Lapeer Rd. with the Tax ID of 74-25-0047-1002-1000. Has nowhere to put the soil and has contacted Matt Collett to remove the sand. Pond will be 25 feet deep.
 
Barrett asked if there would be any problems with putting up a reclamation bond of $1,000 as well as no weekend work with hours from 7am-7pm. Mr. Wessell stated that it would not be a problem. Barrett also requested that the application be signed and have a phone number on it.
 
Public Comment on Hearing:
 
-Letter to the Planning Commission read by Mr. Orr:
Wayne and Debby Wolfe township residents, with a business located in proximity of property. Concerns over low water levels in the area.
 
-Terry Phillips speaking for homeowner located at 6292 Lapeer Rd concerned about their well drying up. Also concerned about the sand being sold. The well depth at this property is 119ft.
 
-Mr. Wessel:
1/3 of the Pond sand has already been taken out. Plans on eventually building a home on property.
 
Hearing will stay open until 30 minutes has passed
  
  1. New Business  
Quick introduction of Greg with Interstate Capital. Purchased Afar property on Range Rd. Working on securing it and looking forward to working with the township to develop it.
  
  1. Old Business  
 
Barrett motioned to table A. until after D. in the Agenda. Tuttle supported that. All were in favor, Motion Carried.
  
  1. Kimball Twp Development Focus District (FD) for the Master Plan 
Tabled until after D.
 
  1. Sparlingville Baptist Church-update 
Thomas Jones, church attender, concerned at how long it is taking. Pastor Abe Braun also there on behalf of Sparlingville Baptist Church.
The problem is the township has had 2 separate engineers looking at site plans and both say the same thing. Barrett stated that all that needs to happen is to change the site plan to reflect the concerns.
Discussion.
Barrett made a motion to postpone Sparlingville Baptist Church site plan so they can come back with an updated site plan to reflect what Tetra Tech wants to see in the site plan until the November 25, 2025 meeting. receive and file August and October’s letters. Tuttle supported the motion. Roll Call Vote: All Yes. Motion Carried.
 
Public Meeting Closed
Barrett made a motion to close the Public Hearing at 7:02pm. Supported by Tuttle. All were in support. Motion carried.
 
Discussion
 
Barrett moved to approve the Special Exception Use for a Pond located on Lapper Rd with Tax ID # at no more than 1.5 acres and no deeper than 25 feet deep with work being done Monday through Friday 7am-7pm with a review to occur at the January 26, 2026 Planning Commission meeting. Access to be on the West side of the property. A $1,000 acclimation bond to be placed on file with a completed application. (Signature and phone number required) Supported by Tuttle.
 
Roll Call Vote: Barrett, Tuttle, Orr, Lokers, Miller, Henry all voted Yes. One absent. Motion Carried.
 
  1. Atkins Meadows and Allen Rd Sewer update 
Neil Erickson gave an update on the sewer project on Allen Road. Still on hold, waiting on the Township board to move forward.
 
Folske 2025- will be tapping off of Allen Rd. not Lapeer rd.
 
Barrett moved to receive and file information on Sewer main on Allen road between West Water and Lapeer rd. Supported by Tuttle. All were in favor. Motion carried.
 
  1. Timber Meadows Site Plan – Extension Request  
Planning on moving forward with duplexes on Griswold rd.  
Barrett made a motion to deny request to extend the extension of the original site plan since it has been more than 12 months. Motion died due to lack of support.
 
Barrett motioned to extend a new site plan within 12 months. Supported by Lokers.
Roll Call vote: NO Barrett, Orr, Lokers, Miller, Henry, motion dies.
 
Discussion
 
Barrett motion to extend Timber Meadows site plan to June 30, 2026. Support by Tuttle. Roll call vote: No-Barrett, Henry.   Yes-Tuttle, Orr, Lokers, Miller
Motion carried.
 
 
  1. Kimball Twp Development Focus District (FD) for the Master Plan 
Introduction from the Kimball Township lawyer, Al Francis. Mr. Frances talked about the language on the Development Focus District and how it differs from a Planned Unit Development.
 
Barrett motioned to approve a work group to work on the DFD with 3 from planning and 2 from the township board so that it complies with the Open Meetings act so there will not be a quorum. Supported by Tuttle. All were in favor. Motion Carried.
  
  1. Audience Participation  
Owner of D&M Landscape located at 2728 Barth Rd. Asked how many special exceptions can a piece of property have? Concern about a neighbor and about his sand being moved on property causing issues when windy.
