The Smiths Creek Land experienced failures in its gas collection system resulting in the release of noxious odors caused primarily by hydrogen sulfide. The odors occurred primarily In 2023 and 2024. As a result, EGLE investigated the landfill and issued multiple violations.
The consent order is a negotiated settlement, including penalties, specifying the terms and conditions of a resolution. Each subject matter must be brought into compliance within the agreed upon time frame.
The agreement also specifies the penalty for the failures that generated the Consent Order. In this case the County, and ultimately tax payers of the county will pay a civil fine of $145,000. Additionally, enforcement costs of $18,700 for a total of $163,700.
The County Board of Commissioners will be discussing the consent agreement at their meeting on Thursday, April 17. The Township has reached out to EGLE to have a public hearing or townhall on the agreement. Once we have confirmation we will post the meeting data and time.
