PUBLIC HEARING/REGULAR MEETING MINUTES
JUNE 24, 2025
6:30 P.M.

Orr opened the meeting at 6:30 p.m. with the Pledge of Allegiance.
ROLL CALL OF OFFICERS: Orr, Henry, Lokers, Barrett, Miller, Tuttle, and Howard.
ABSENT: None.

APPROVAL OF AGENDA
Barrett motioned to approve the agenda as presented support by Tuttle.
Motion Carried.

PRESENTATION OF MINUTES
Barrett mentioned that on page 2 there is a duplication of the word had in the last paragraph, and page 4, the last line replace the word boards with plans and I
think that it is important that we add on page 5 in regard to the discussion of the property that we are going to talk about that the owner is Mr. Erickson.
Barrett motioned to approve the minutes as amended supported by Tuttle.

PUBLIC HEARING

Barrett motioned to open the public hearing at 6:31 p.m. for New Beginnings
Apostolic Church – 5801 Griswold Road Tax ID 74-25-015-1006-000; Special
Exception Use supported by Tuttle.
Sean Cabot, Pastor of the New Beginnings Apostolic Church introduced himself and explained what they are planning to do there.
Erickson explained that they did not have Special Exemption Use with the last owners of the church and that it was his fault and would ask that you grant them Special Assessment Use.
Barrett asked if the term “church” would fulfill their needs?
Cabot said that that should be good.
Barrett motioned to close the Public Hearing for New Beginnings Apostolic Church at 5801 Griswold Road at 6:36 p.m. supported by Henry.
Motion Carried.
Barrett motioned to approve the Special Exception Use at 5801 Griswold Road as a church allowed in the R-2 zoning district supported by Howard.
Motion Carried.
PUBLIC HEARING:

1350 Pine River Rd; Tax ID 74-25-021-2016-000; Special Exception Use:
Kennel Reinstatement. 1414 Pine River Rd; Tax ID 74-25-024-2013-000: Removal of Special Kennel Use.
Barrett motioned to open the Public Hearing at 6:37 p.m. regarding the Special Use at 1414 Pine River Road and 1350 Pine River Road in its continuation supported by Tuttle. Motion Carried.
Tricia Benson: I own Pine River Newfoundland’s, and I am asking if I can continue to have my kennel at 1350 Pine River Road.
Orr asked why she is looking to get it re-instated.
Benson explained that she was having trouble with the people that were helping her. Her husband has been working on a fence.
Barrett asked where it stands with the Animal Control for St. Clair County being with the license that you had to request through them?
Benson talked to Animal Control, and they said it was revoked, and she would have to come to the Planning Commission Meeting to get approval and then take it back to Animal Control.
This hearing will last for 30 minutes.
A letter from Marilyn Samson was read to the board.
Orr would like to have the letters received and filed.

CLOSE PUBLIC HEARING
Pine River Newfoundland Kennel
1350Pine River Road
1414 Pine River Road
Barrett motioned to close the Public Hearing regarding 1350 Pine River Road and 1414 Pine River Road at 6:45 p.m. regarding the status of their special Exception Use supported by Tuttle. Motion Carried.
Barrett motioned to continue the Special Exception Use at 1350 at Pine River Road as stated with the additional requirements being that all dogs are licensed through St. Clair County Animal Control also a front yard fence is installed at the property no later than November 24, 2025 and request the applicant before the Planning Commission for review at its regular November 25, 2025 Meeting supported by Miller. Motion Carried.
Lokers motioned that we add that Mrs. Benson must provide us with the SOP’s, so we have the basic understanding that she has procedures to be done by November 24, 2025, supported by Barrett. Motion Carried.
ROLL CALL VOTE: YES: Lokers, Barrett, Orr, Miller, Henry, Howard, and Tuttle.
NO: None. ABSENT: None. (7-0-0) Motion Carried.
Tuttle motioned to amend that Mrs. Benson does not need to have individual licenses for each dog if she has a Kennel License supported by Barrett.
Motion Carried.
All dogs licensed through Animal Control, front fence on property, they have until November 24, 2025, and attendance to the November 25, 2025 Planning Commission Meeting with an amendment to the SOP’s and not required to have individual licenses for the dog if she has a Kennel License. Motion Carried.
Barrett motioned to revoke the Special Exception Use at 1414 Pine River Road as Kennel use supported by Howard. Motion Carried.

PUBLIC HEARING
4917 Lapeer Rd; Tax ID 74-25-001-4007-700: Requesting Special
Exception Use Per Ordinance 142;20.C103C #9
Barrett motioned to open the public hearing at 6:45 p.m. for 4917 Lapeer Road requesting a Special Exception Use supported by Tuttle. Motion Carried.
Neil Erickson, 4917 Lapeer Road. I came to you last month to verify an accessory building in a residential area, and you cannot build any bigger than the home. I built a barn a little less than the square footage of the house and it is zoned C-1. I was told to come to this meeting to apply for Special Exception Use. This is going to be a workshop for my tools. I am looking at building a size 24 X 30 or 24 X 24 to the back, whichever you will allow me to build.
Barrett asked Erickson what size for clarification is the building going to be.
Erickson: I am going to go with 24 X 30.
Barrett questioned that this will be attached? It would be a total of approximately 1,500 square feet.
Erickson: Correct for personal use. I have had a renter living there for 24 years and she has half of his other garage, and I have the other side.

CLOSING PUBLIC HEARING
Barrett motioned to close the public hearing at 6:49 p.m. regarding 4917 Lapeer Road request for Special Exemption Use supported by Tuttle.
Motion Carried.
Barrett motioned to approve the Special Exemption Use at 4917 Lapeer Road which is the accessory usage with the condition that the detached garage is extended no larger than 24 x 30 and is used as personal space by property owner or renter supported by Miller. Motion Carried.

NEW BUSINESS

Atkins Meadows: Sewer petition signed. Storm and pond care to be in condominium documents.
Erickson explained that the documents for the Condominiums Maintenance Agreement are going to be in with the Condominium Agreement. I have a signature from Acciavatti for the sewer petition. I’ve gotten ten out of the fourteen yeses so far for the petition.
Barrett asked where does it stand? The ordinance says that we are supposed to have a copy of the signed Condo agreement before approving it overall. Is it done with the township attorney?
Erickson said it should be here at the next meeting.
Barrett motioned to postpone Atkins Meadows final approval regarding the Condominium and place it on the July 22 Planning Commission Meeting supported by Henry. Motion Carried.

Sparlingville Baptist Church: 5230 Griswold Rd, Modified Site Plan, to accommodate retention pond with review by township engineer.
Erickson explained that the engineers site plan did show the retention pond in the back, but the calculations aren’t correct, per PCE. (added by motion 7-22-2025)
Barrett motioned to postpone the Modified Site Plan Approval for Sparlingville Baptist Church at 5230 Griswold Road regarding retention pond in review by township engineer and place in the July 22nd Planning Commission Meeting supported by Henry. Motion Carried.

Timber Meadows– Updated Site Plan only contains Brownfield. Township Board minutes included in packet.
Erickson said that they did not approve Brownfield.
Lokers mentioned that he does not think that this is a good deal for the township.
Barrett mentioned that the township can opt out on it.
Lokers: Said they could go to the county.
Barrett: We can still opt out.
Discussion.
Erickson: My question to the board, when do we start the year off process?
Barrett: The ordinance says commencing on the day of the final approval of the Planning Commission.
Barrett motioned to place Timber Meadows Site Plan Continuation on the July 22nd agenda regarding 20.1307 of the zoning code specifically site plan application, determination, and approval extensions if one is being requested and give notice to the applicant of such discussion supported by Tuttle.
ROLL CALL VOTE: YES: Barrett, Tuttle, Orr, Lokers, Miller, Henry, and Howard.
NO: None. ABSENT: None. (7-0-0) Motion Carried.
VII. OLD BUSINESS
MASTER PLAN – Development Focus (DF) District definition for Kimball Twp
Erickson said that we did not have a definition for Future Land Use.
Barrett asked where his sample came from.
Erickson said that Usakowski and he went onto the MTA website and searched and came up with the best scenario that we thought fit.
Barrett motioned to place the continued conversation about a development focused district definition, aka zoning amendment to Ordinance 142 on the July 22nd agenda supported by Henry. Motion Carried.

Gary Lokers, Kimball Township Board of Trustees
Lokers explained that he has been working on an ordinance regarding rental properties. I talked to Mr. Lewandowski at Port Huron Township about it. He asked what sparked this and I let him know.
